Afek Tounes parliamentary bloc challenges IVD’s decision to extend its mandate

The elected members of the parliamentary bloc of Afek Tounes will file, on Thursday, a legal remedy before the Administrative Court against the decision of the Truth and Dignity Commission to extend its mandate and to request suspending its application, said the group’s president, Lilia Ksiksi.

In challenging that decision, MPs referred to Article 49 of the Constitution and Article 59 of the Organic Law establishing the quorum procedure and Article 18 of the Organic Law on the establishment of transitional justice and its organisation, Ksiksi told TAP.

Article 18 states that “the duration of activity of the Commission is fixed at four (4) years, as from the date of appointment of its members, renewable once for a year, and, by motivated decision of the Commission to be submitted to the legislative assembly, three months before the completion of its activity”.

For the president of the Afek Tounes parliamentary group, the decision of the IVD has a shortcoming because the quorum is not reached in the Commission.

The IVD has not also submitted a motivated decision to the Parliament which must decide the question and accept or not the decision to extend its mandate of activity.

The Board of the Truth and Dignity Commission, on Tuesday, announced the decision to extend the mandate of the Authority by a year, in accordance with Article 18 of the Organic Law on Transitional Justice. This decision was taken at the Board meetings on February 15, 26 and 27.

The mandate of the IVD will expire on December 31, 2018, according to a schedule developed for this purpose.
