Authority for Prevention of Torture says opposed to trials of civilians before military courts

The National Authority for the Prevention of Torture (French: INPT) said it is utterly opposed to trials of civilians before military courts. They run counter to the provisions of the constitution and international conventions ratified by Tunisia, it said.

In its October report released Thursday, it shed light on attacks on bloggers. “A number of trials before military courts took place against the backdrop of social media posts criticising the President of the Republic- the Supreme Commander of armed forces,” it said.

These are “political and personal positions towards the Head of State as a public figure.” If the latter are to be incriminated, this will not be before a military court, the authority said.

The INPT also rejected custodial penalties in trials related to press and publishing “except for crimes of incitement or serious threats meeting objective criteria.”

In addition, the report focused on transitional justice.
