CSM-HPR: 34 signatures collected to challenge government’s legislative initiative

Thirty four signatures from the various parliamentary groups were collected to challenge the adoption of the bill amending and supplementing the law on the Supreme Judicial Council (French: CSM), MP Aymen Aloui (Popular Front) said on Tuesday. Interference in the judiciary is a red line, he warned.

During the general debate, Minister of Justice Ghazi Jribi said the decision rendered the previous day by the Administrative Court has no connection with the legislative initiative to resolve the crisis of the CSM.

He stressed the urgent need to resolve this issue as soon as possible and to initiate the establishment of permanent constitutional bodies.

In his view, the legislative initiative does not constitute an interference in the judiciary affairs or an attempt to get hold of the judiciary.

It is a formal procedure under which the Parliament Speaker convenes the first meeting of the CSM without interfering in its organization and conduct, he pointed out.

The minister criticised the attitude of the provisional judiciary authority, saying it has not sought to fill the vacancies and whose chairman failed to convene the meeting of the CSM, insisting on the urgency of moving to permanent institutions.

The draft law amending and supplementing Organic Law No. 2016-34 of April 28, 2016 on the CSM was adopted by a majority of 120 votes in favour, 2 against and 12 abstentions.

It is a government legislative initiative that has been proposed to put an end to the persistent disagreement between the judicial structures, for more than 4 months after the election of members of the CSM in October 2016.

Before voting the bill article by article, the parliamentary groups of the Free Patriotic Union, the Popular Front and the Democratic bloc pulled out n rejection of the bill.

The Administrative Tribunal decided on Monday to suspend all decisions announced on behalf of the Supreme Council of the Judiciary and the continuation of the mission of the Provisional Judicial Authority until the installation of the CSM.
