Local Government Code: 33 Government decrees under development by Local Affairs Ministry (Minister)

The Ministry of Local Affairs and Environment has drafted nearly 33 government decrees relating to the Code of Local Government whose rate of advancement has reached between 80% and 90%, said Minister of Local Affairs and Environment Riadh Mouakher.

The ministry will work to complete them in the coming months according to their priority, he said.

At a press conference on the Code of Local Government, Riadh Mouakher said the adoption of the code “is the beginning of the process of implementation of decentralisation that is more than a technical project, a project of a state policy”.

To succeed in the process of decentralisation, he explained, it is necessary to provide the necessary human resources to local communities and regions and to find the necessary material means. The Local Government Code will allow municipalities to boost their tax revenues, he added.

Besides, the minister denied the claim that this process “would give legitimacy to the decentralisation of corruption and threaten the unity of the state”, saying that local communities are subject to the rules of public accounting. The Court of Auditors can be the interlocutor of citizens and representatives of civil society who wish to warn about possible malfunctions.

As for the threat of the unity of the state, the minister recalled that the decisions of the central power are applicable to local authorities “who are not able to take decisions contrary to national legislation”.

He explained that on the contrary, the code allows greater flexibility in the management of municipalities and the implementation of municipal projects and grants more prerogatives by devoting the principle of self-management (maintenance of public service establishments).

The House of People’s Representatives adopted the Local Government Code on April 26 in its entirety, with 147 votes in favor, 0 against and 10 abstentions.

The draft organic law was adopted after the addition of 10 articles proposed by the initiator of the project, namely the Ministry of Local Affairs, and two articles proposed by deputies. Several other proposed articles were withdrawn or rejected after being put to the vote.
