State to initiate all possible proceedings concerning verdict pronounced in the BFT case (Mabrouk Korchid)

The Tunisian State will initiate all possible procedures concerning the verdict against it for the benefit of the Banque Franco-Tunisienne (BFT) and having decided on major compensation (forecasts exceeding one billion dinars), said Secretary of State to Land Affairs Mabrouk Korchid, in an interview granted to the daily “La Presse”, of Sunday.

The International Arbitration Committee, to which the dispute between the Tunisian State and the foreign investor ABCI concerning the BFT was entrusted, published its decision on July 19, 2017, according to which the responsibilities were delimited and experts were appointed to fix the damage having occurred and consequently the compensation.

Korchid said in this connection that “the compensation will not be paid immediately because the verdict which fixes the amounts has not yet been pronounced, it will be pronounced only by 4 or 5”.

The official specified that the National Union government is guilty of nothing in this case that goes back to the year 1981, adding that the pleadings and remedies ended in March 2016.

Regarding the conditions under which the verdict was pronounced against the Tunisian State, he said: “one can forgive a lawyer, except treason, and continue that” without betrayal, Tunisia would not have lost this trial of the BFT, “declaring that” the Tunisian State has been betrayed. When one gives a precious document to the opponent that the latter uses to beat you, it is called treason…… “.

The Secretary of State recalled that the “valuable” document used against the Tunisian State “is an aminist issued in 2012 to our opponent certifying to him that he is a victim, that all that he underwent in the time of Ben Ali was part of the political harassment and that all its commitments to Tunisia were under duress. “

The opponent, he said, handed the document to the arbitration committee, which gives him the status of “victim”, pointing out that the verdict was pronounced for the period after 1989 and not from 1981.

Korchid argued that the Tunisian state issued the key to the case in 2012, which resulted in the 2017 verdict. “It is unfortunate, but responsibility lies with the Minister of State Properties and land affairs at the time, he regretted.

During a plenary dialogue with the House of People’s Representatives (HPR) held last Thursday on the fight against corruption and the general situation in the country, Prime Minister Youssef Chahed declared that the verdict in the BFT case seeks to assume responsibility and has not imposed a fine contrary to the allegations.

“This case before international arbitration dates back to 1982 and the Tunisian state has instructed lawyers in the major offices of Great Britain. After having taken full knowledge of this file, public opinion will be informed and the state will appeal the verdict if necessary, “he said.
