Supreme Court Overturns Ga Mantse Restoration Order

Accra: The Supreme Court has dismissed an order directing the National House of Chiefs to restore Nii Tackie Adama Latse II to the national register of chiefs as Ga Mantse. This decision followed a certiorari application filed by counsel for Nii Tackie Teiko Tsuru, Professor Peter A. Atupare.

According to Ghana News Agency, a ruling delivered on Wednesday, July 23, 2025, by a five-member panel of the apex court, presided over by Justice Gabriel Scott Pwamang, concluded that the Kumasi High Court erred by not notifying or hearing Nii Teiko Tsuru prior to issuing the restoration order. The Court emphasized that the High Court's actions infringed upon the rule of natural justice by denying Nii Tackie Tsuru his constitutional right to be heard in a matter that affected his interest as Ga Mantse.

Previously, Nii Adama Latse II had secured an appeal at the Court of Appeal. On June 12, 2025, the court ordered the National House of Chiefs to restore his name to the register as the Paramount Chief of the Ga State within 14 days. This decision upheld a November 2021 ruling by the Kumasi High Court, noting that there was no evidence of destoolment, abdication, death, or any adjudication justifying the removal of Nii Adama Latse's name.

The Court of Appeal had ruled that the National House of Chiefs in Kumasi removed the name of Nii Latse II from the national register without any evidence of his death, deposition, or abdication, nor any adjudicatory body ordering the removal. The panel noted that the decision by the National House of Chiefs was beyond their powers, constituted an abuse of power, and was an erroneous exercise of discretion.

In April 2021, Nii Adama Latse discovered that his name had been removed from the register. Following a search by his legal team with the National House of Chiefs in Kumasi, the removal was confirmed. A formal objection was filed, requesting reinstatement by April 27, 2021, but it was rejected. Consequently, Nii Adama Latse sought judicial review at the Kumasi High Court, which granted an order for his name's restoration. However, the National House of Chiefs appealed, arguing that the High Court lacked jurisdiction over the matter. The appeal was dismissed by the Court of Appeal, which confirmed the High Court's order for reinstatement.
