The Union of Magistrates of the Court of Auditors considered that the decree on the temporary Supreme Judicial Council is a direct interference in the judicial system, denouncing any form of pressure on judges.
For the Union, this decree will not contribute to solving the real problems of the judicial system.
On Sunday, February 13, President Kaïs Saïed replaced the Supreme Judicial Council (CSM), which he dissolved a week ago, with another “temporary” authority. The composition of the temporary CSM, its prerogatives as well as the areas of intervention of the head of state have been defined.
In a statement issued on Monday, the Union of Magistrates stressed that the decree on the temporary CSM represents a step backwards in relation to the achievements of the judiciary, particularly with regard to articles 9, 19 and 20. This decree infringes on the union rights of judges, guaranteed by the constitution and international treaties, warns the Union.
It also reiterated its commitment to the Supreme Judicial Council as the guarantor of the independence of the judiciary, recalling that any reform process must involve the judiciary, without any exclusion.
